On July 28, 2004 in Toronto Ontario Canada Bruce Ryan and Pierre Champagne picketed the office of Crown Attorney Jeffrey Roi at the old Toronto City Hall and delivered a protest note about the Crown refusing to hand over the seized pot and equipment that should have been returned when their marijuana charges were withdrawn.
The Sec. 56 Medical Cannabis Club was raided on May 6 and Sept. 30 last year and they were charged with possession of marijuana over and under, trafficking, cultivation, production of derivatives and cookies and other marijuana charges. These charges were withdrawn by the crown after a motion from the accused demanded to have them withdrawn for an offence unknown to law, because the Cannabis Prohibition Law has been REPEALED.
We are constantly being given the wrong messages...
The REAL four messages ARE: one: Two separate superior court decisions in different provinces of the country have REPEALED the Cannabis Prohibition. It's as dead as abortion or capital punishment. two: We proved Cannabis Prohibition continues to be dead, in court! We made the motion to dismiss and withdraw the charges because the law is REPEALED, they withdrew all the charges. More have done the same since and had their charges withdrawn. three: The crown is lying to the media and the police. The police refuse to give us our medicine back. The media has not informed the public that Cannabis has been legal since 1997, people continue to be arrested unlawfully, sick people, who could be helped, continue to die.
four: Only Parliament can create a law. Repealed Laws cannot be resurrected by a court. Any new law is RECRIMINALIZATION. Cannabis is legal for all, RIGHT NOW.
We must stop any attempt to RECRIMINALIZE without just cause. They must now prove the need for any such law. Cannabis is good for even sick people, it is good for everybody. Let your food be your medicine and let your medicine be food.

Marc, thanx so much for your honest and forthright answer to the question of legality of Cannabis in Canada. I do not speak openly about this as people hear different things, are confused easily, argue consistently and I don't have the energy to play that game....  I - like you - just keep telling people there IS a Law according to what Alan and I talk about. Thank you openly for everything you have ever done for us.... Hi Marc and all,while I understand your reasoning for the statement I would like to expand on it.I will keep to the Hitzig ruling.I believe the reason the appeal was turned down is that the group had "won" what arguements they placed before the court,namely supply(flin flon).As to the ruling bringing back the "law" by making the MMAR constitutional with certain defects remedied.The goverment has complied by only changing certain sections,I believe there were 5 in total,the goverment has only changed 3 in the latest gazette.The short of it is,even if the goverment enacts the changes in the future as intended now,they will still have not made MMAR constitutional because of the remaining 2 they refuse to enact.Without all the changes,it remains unconstitutional in the eyes of the Ontario Appeal court.The crown also is aware of anyone that can present this to a judge in a credible way will eventually win.It could take years,but would prove out.The crown is withdrawing and staying charges all the time,even after the Oct/2003 date.In my personal opinion,it has been legal to posess for everyone since Aug 1/2001 and remains so.Any questions/comments welcomed.
