Nimbin's Twelfth MardiGrass and 'Just Say Know' Cannabis Law Reform Weekend
on the 1 and 2 May has already attracted early campers in the village.
"MardiGrass is now an international cultural event which is very popular in
the backpackers' calendar as well," said Michael Balderstone, spokesperson
for the annual Rally. "It is a unique event which suits our unique
community. It's an added bonus that it has real purpose and meaning for a
lot of people."
This year's MardiGrass is tackling the difficult subject of cannabis and
mental health with a "Pot Psychosium" to be held in the Nimbin Town Hall on
Saturday 1 May from 12 noon.
"As the name suggests, the discussion will examine the mental health
aspects of today's cannabis use in Australia. We have invited doctors and
other health professionals and urge concerned parents and young cannabis
users to also attend".
"We hope the mothers who were on the front page of The Northern Star a
couple of times in the last year saying their children had ended up in
Richmond Clinic after smoking cannabis will come forward and tell their
stories, for example", said Michael.
John Howard, Director of Clinical Services for the Ted Noffs Foundation,
will facilitate the discussion and it is expected the Prime Minister's Chief
Drug Adviser, Major Brian Watters, is also attending.
"'Cannabis psychosis' is the big stick used by prohibitionists these days
and we hope to explore whether it's made of hardwood or hollow", said
Michael.
"We hope to identify what is really going on from the experts in the field
and gain some sort of consensus on what can be done to minimise harm, under
the current constraints of prohibition."
The MardiGrass Opening Ceremony is in Peace Park at sunset on Friday, 30
April, with Bundjalung Elders and a Ganja Harvest Dance performance by local
musicians and dancers, Voodoo Jive, followed by the Annual Picker's Ball.
The Hemp Olympix opens at 11am on Saturday for the now famous Joint Rolling,
Bong Throwing and Growers' Iron Person Events. There are more heats on
Sunday morning followed by the finals, again all compered by masters of
laughter S Sorrensen and Alan Glover.
The rest of the weekend is a smorgasbord of book launches, film premieres,
concerts, exhibitions, performances, the inaugural Marijuana Music Awards at
the Rainbow Cafe, Pot Poetry and Pot Art, the Cannabis Cup, Harvest Festival
Ball, MardiGrass Markets and much more all over and around the village which
comes together for the Big Protest March and Rally for Cannabis Law Reform
at 1pm on Sunday.
The Kombi Konvoy travels from Byron Bay this year on Saturday to arrive in
Nimbin at 4.20pm to join the Million Marijuana March, happening
simultaneously around the earth in almost 300 cities on the weekend.
MardiGrass is a grass roots movement and volunteers are its backbone.
MardiGrass relies on local volunteers who can also guide international
tourists who volunteer at MardiGrass.
An all weekend MardiGrass pass costs only $20, payable on arrival. The
Nimbin HEMP Embassy is a non-profit group which believes this important
cultural weekend should be accessible for all comers.

LAST YEARS event was held in McPherson Square (15th & I). People started gathering a little before 12:30pm, with speakers first (after some minor technical difficulties with the sound system) and the march itself starting just before 3:00pm. The march was followed by live music from artists supporting the movement (4 total): HURT (hurtband.com) was our biggest band at the event and made quite a trek here to perform for us- all the way from central VA. Oneirogen (lsdrecords.com) was our opening act. Enoch 212 (link to their site in the bands section) also performed and a solo artist, Jonathan, who does not have a web site. At peak we had about 60 people at the event. There was even a documentary crew there interviewing people.
There were reps from other organizations at the event (most notably MD NORML) and people handing out free hemp pretzels. I hope everyone got some good information and had a great time!

Judge Refuses Probation for Man Convicted of Selling Marijuana
Hahn gets 10 years for drug offense Daily Journal Staff Writer
FARMINGTON -- A Farmington man was sentenced to 10 years in prison for selling
marijuana.
Circuit Court Judge Sandra Martinez sentenced Robert H. Hahn, 26, to 10 years for sale
of a controlled substance. The sentence will run concurrent with another case he had
been on probation for.
According to court records, Hahn sold more than five grams of marijuana to a
confidential informant.
Hahn's attorney, Daris Almond, asked the judge to consider probation or 120-day drug
treatment despite the State Board of Probation and Parole's recommendation against
probation.
Almond argued that Hahn is not a dangerous man and the presentence investigation report
did not say he was a threat to society.
Almond said Hahn has already taken enormous steps toward rehabilitation. He said his
probation officer said Hahn has made a complete turn-around.
Almond said Hahn has had problems with drugs and alcohol since he was a teen.
But Assistant Prosecuting Attorney Patrick King said he didn't think it was possible
for Hahn to succeed on probation. King pointed out Hahn had completed a 120-day shock
treatment and had been on probation only six months when these violations occurred.

I spoke today to "DC" who is doing Weedstock events in CA and
think you two should talk. I sent him your phone number along
with MMM update #23 for his review. In addition to Monday May 3
Bakersfield walk at Congressman Thomas' office we are trying
to put together a Weedstock event in Bakersfield for May 1-2
as part of MMM events this year. Hope later today or tomorrow
to have more details as this will be discussed at the Weedstock
event in Merced tomorrow where among others will be Chris
Conrad and Jack Herer.
My rants to Jeff Nunez and DC were along lines of mobilizing
all hands to go to local congresspeoples' offices in their districts
after May 1-2 events, ie, 11am Monday May 3, with news folks to offer
copies of several alternative national relegalization bills to their
congress peoples offices with requests for evaluation, suggestions,
and introduction of bills into Congress for relegalization, eg, medical
only, industrial only, medical and industrial uses only, full relegalization
etc.
That way it's not a choice between yes and no, but a choice
between all good. And this overture will bring out the truth to
the public via the news media eager to cover the story after
such overtures locally and especially after such draft bills introduced
to congress by someone -- anyone.
DC is dynamic and emerging CA powerhouse on medical mj
issue in CA seeking injunction expected within 90 days to stop
all hassles of patients in CA and think it good for you two to talk

On May 22, 2003, the United Nations Security Council passed Resolution 1483, abolishing sanctions against Iraq and recognizing the United States and United Kingdom as the country's occupying powers. The resolution called upon the US-UK Authority to "comply fully with their obligations under international law, including in particular the Geneva Conventions of 1949 and the Hague Regulations of 1907."[1]
How has the CPA changed Iraq's economy and laws?
Among many changes, the US-UK Coalition Provisional Authority (CPA) has laid off hundreds of thousands of Iraqi workers, virtually eliminated trade tariffs and enacted laws that radically alter Iraq's economy. Order 39, announced by CPA head Paul Bremer on September 20, abolished Iraq's ban on foreign investment, allowing foreigners to own up to 100 percent of all sectors except natural resources. More than 200 state-owned enterprises, including electricity, telecommunications and pharmaceuticals, have been privatized. Iraq's highest tax rate has been lowered from 45 percent to a flat rate of 15 percent. Although foreign ownership of land remains illegal, companies or individuals will be allowed to lease properties for up to forty years.[2]
Are these changes legal?
These laws stand in clear violation of Iraq's Constitution, as is openly admitted. The US Commerce Department notes that "the Iraqi Constitution prohibits foreign ownership of immovable (real) property," and "prohibits investment in, and establishment of, companies in Iraq by foreigners who are not resident citizens of Arab countries."[3]
Consider how the CPA's new laws and massive layoffs conform to its obligations under international law[4]:
Hague Regulations
Article 43. The authority of the legitimate power having in fact passed into the hands of the occupant, the latter shall take all the measures in his power to restore, and ensure, as far as possible, public order and safety, while respecting, unless absolutely prevented, the laws in force in the country.
Article 46. Family honour and rights, the lives of persons, and private property, as well as religious convictions and practice, must be respected. Private property cannot be confiscated.
Article 47. Pillage is formally forbidden.
Article 53. An army of occupation can only take possession of cash, funds, and realizable securities which are strictly the property of the State, depots of arms, means of transport, stores and supplies, and, generally, all movable property belonging to the State which may be used for military operations.
All appliances, whether on land, at sea, or in the air, adapted for the transmission of news, or for the transport of persons or things, exclusive of cases governed by naval law, depots of arms, and, generally, all kinds of munitions of war, may be seized, even if they belong to private individuals, but must be restored and compensation fixed when peace is made.
Article 55. The occupying State shall be regarded only as administrator and usufructuary of public buildings, real estate, forests, and agricultural estates belonging to the hostile State, and situated in the occupied country. It must safeguard the capital of these properties, and administer them in accordance with the rules of usufruct.
Geneva Conventions:
Article 53: Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or cooperative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.
Article 54: The Occupying Power may not alter the status of public officials or judges in the occupied territories, or in any way apply sanctions to or take any measures of coercion or discrimination against them, should they abstain from fulfilling their functions for reasons of conscience.
What is usufruct?
In accordance with Article 55 of the Hague Regulations, the US-UK are "regarded only as administrator and usufructuary" of Iraq's resources and immovable property, which it must administer "in accordance with the rules of usufruct." Bouvier's Law Dictionary defines usufruct as: "The right of enjoying a thing, the property of which is vested in another, and to draw from the same all the profit, utility and advantage which it may produce, provided it be without altering the substance of the thing."[5] As usufructuary, the US-UK coalition would have the right to use Iraq's resources without altering or destroying the character of the resource itself. It is widely recognized that agriculture, wherein crops can grow again and no serious effect is made on the soil or the land, is an appropriate usage of the right of usufruct. But oil is far different: The extraction of oil is the process of extracting the original resource itself, as the fossil fuels are not renewable and the character of the land from which it comes is severely altered, if not depleted.
In addition, the responsibilities of usufruct can also apply to structural changes to a public resource or service. As Naomi Klein points out, "What could more substantially alter 'the substance' of a public asset than to turn it into a private one?"
Does the CPA know this already?
In a leaked March 26 memo that caused a stir in Britain, Attorney General Lord Peter Goldsmith advised Prime Minister Tony Blair that the invasion and subsequent occupation of Iraq was illegal. "My view is that a further Security Council resolution is needed to authorize imposing reform and restructuring of Iraq and its government," Lord Goldsmith wrote. He added that in his view "the imposition of major structural economic reforms would not be authorized by international law," and that "the longer the occupation of Iraq continues, and the more the tasks undertaken by an interim administration depart from the main objective [of disarming Saddam], the more difficult it will be to justify the lawfulness of the occupation."[6]
