Doctor, Wife Sentenced To 5 Years in Prison in Medical Marijuana Case

CA -- A doctor and his wife from El Dorado County were both sentenced Wednesday in Sacramento federal court to five years in prison for conspiracy to grow marijuana and manufacturing it in a medicinal marijuana case.

U. S. District Judge Frank C. Damrell Jr. said federal law left him with no choice but to impose the mandatory minimum sentence in each case.

The statutory minimum applied because a jury in August found Dr. Marion "Mollie" Fry and attorney Dale Schafer guilty of conspiring to grow and distribute at least 100 pot plants at their offices in Cool and their home in Greenwood.

Hard-wired for prohibition

Mayor Frank Guinta has asked state Rep. David Scannell to resign as spokesman for the Manchester school district after Scannell voted Tuesday to decriminalize possession of small amounts of marijuana.

The notion of calling for the resignation of someone from a public position for their vote as a representative in the State House is extraordinarily absurd, particularly when coming from a public official invoking logic while demonstrating a complete lack of it.

But it's also a very telling moment as it relates to drug policy. Sure, Guinta's a moron. But how did he arrive at such a low point of humanity?

I'm convinced that there is a small core segment of the population that has so thoroughly drunk the kool-aid of prohibition that they firmly believe two propositions to be as true as the law of gravity:

1. Marijuana is very, very bad. Always.
2. An effective way, and the only way, to deal with marijuana is through strict prohibition

Despite being completely wrong, these two points are so ingrained that these people will not/cannot comprehend/listen to any rational arguments, so they assume that no rational opposing viewpoint exists. Thus, anyone who has an opposing viewpoint must want bad things to happen and should therefore certainly not be put in any connection with young people.

Prohibition propaganda overrides parts of the brain that actually allow rational thought. This makes our job much harder... DWR Pete Guither

Marian "Mollie" Fry, MD, and her husband Dale Schafer, an attorney, turned themselves to U.S. marshals Monday, May 2. They were taken to the Sacramento County jail, where they are awaiting transfer to federal prisons. They have begun serving five-year terms -ostensibly for the crime of Cannabis cultivation ( growing plants ), but actually for the crime of political organizing ( educating people ). full story

The Real Crime

Why did federal prosecutors add up plant counts from three years of cultivation to push the total over 100? Why were they so bent on making Mollie Fry and Dale Schafer face mandatory-minimum sentences? Why were Mollie and Dale a much more important target than Maggy, the freed informer, who had grown 900 plants and had numerous other offenses on his record?

Because unlike Maggy, Mollie and Dale were political organizers.

I ask YOU if you just Now REALIZED this. I've known it since the 60's.

Fred Gardner wrote the article maybe you should ask him. I realized it was totally political when I got busted 4 times between 1969 and the Controlled Substance Act. That space in time when they didn't know the status. After Tim Leary overturned the Marihuana Tax Act. One of the bust they tried to deal to let the girls off for underage drinking. No deal, and since they entered without a warrant nothing was persued. Then at 17 I hitch hiked to SF. So yes I have known its political. About everything I post shows that and still people think its about doing dangerous drugs or politics. It's plain old Fascism and it can and is happening here. In our 51st state of Canada too.

The reason for the crackdown on buyers clubs is obvious. They are set to re-schedule THC solely for the sublingual spray's and want no competition from homegrown. Keeping Ganja and Hemp from taking Wall St. non-renewable synthetic profits. The USA! Qaeda Terrorizing sick people on tax dollars. It's bad enough when they terrorize sick people but to make them pay for it? That surely is anti-American.

D.E.A. Confirms Grounds To Remove Marijuana From Sched#1 - 10/14/01
On December 19th, DEA formally asked the Department of Health and Human Services to conduct "a scientific and medical evaluation of the available data and provide a scheduling recommendation" for marijuana and other cannabinoid drugs. This DEA request of HHS means that the DEA has for the first time made its own determination that sufficient grounds exist to remove marijuana from Schedule I of the Controlled Substances Act (CSA). Schedule I is supposed to be limited to hard drugs with addictive propensities and with no legitimate medical usage.

That's as far as it went. The IOM is still in file #13...

So, in other words, if a pharmaceutical product contains THC extracted from the marijuana plant, that would be a legal commodity. But if you or I possessed THC extracted from the marijuana plant, that would remain an illegal commodity.
