Too bad the guy isn't actually here to read our posts. If you're his friend and happen to be talking to him sometime, mention that he should make a section 8 constitutional challenge with the argument that they didn't have sufficient information to provide reasonable grounds for a search. He doesn't have to go to the Supreme Court. It's just a regular judge at the normal courthouse who hears the case. It's just you, the judge, the cop who got the warrant and the Prosecutor.

I know a guy who did this. He said it was priceless seeing the look on the Prosecutor's face when the judge gave his ruling, which was right after the hearing. The judge said he was ruling the warrant invalid and excluding all evidence seized. The Prosecutor squirmed a bit and said he didn't have any other evidence. A full acquittal was entered. The person also said it was pretty sweet grilling the cop for about an hour. I wonder how his superiors felt when they heard about how his big grow-op case turned out. They had about 10 guys from the invasion squad all set to testify in the case. Not one of them got a chance to say shit and now the guy has all their names. They had to supply him with all the witness' names. He could hunt them all down one by one if he wanted to. That'd make a cool movie, wouldn't it?

Revenue Canada has request another audit
@ Bob Cajun - He actually is on here reading up. They are worried about becoming involved before their trial comes up as everything can and will be used against them....if it actually goes to trial.

A COUPLE facing charges of running a grow-op in their home will not see additional charges from a second police raid on their house.

Larry Tallon and his wife Lynda had police break down their door in March 2008 after officers believed they were continuing to operate a grow-op that police had found on their first raid on the Halliwell home in September 2007.

However, in March, the Tallons produced a medical marijuana licence, allowing them to grow a certain number of plants, keep a specified amount of cultivated marijuana on hand and take a certain amount with them if they travelled, for Tallon’s undisclosed medical condition.

Police verified the licence was real and left the house.

Late last week, police confirmed that charges will not be forwarded to prosecutors for the March raid on Tallon’s house.

“No charges will be forwarded on the Tallon file you mention,” said Terrace RCMP spokesperson Const. Cindy Nunes.

“Yes a valid medical licence was produced, a file was generated and it has been concluded.”

After the March raid last year, then-Const. Clint Lange, who was with the detachment’s drug squad at time of the raids, said police were wondering how the Tallons got the medical marijuana licence and whether the Tallons had informed the government about the trafficking charges against them when they applied for the licence.

Tallon later said he didn’t tell the government about the charges against him when applying for the licence because the application form didn’t ask that question.

His lawyer, Donald Skogstad, a drug lawyer from Kamloops, believed his clients received their medical marijuana licence about a month before the second police raid.

Tallon could not be reached for comment.

AWESOME! Now they should drop the first charges too....Does it really matter when they got their license? They use and grew cannabis for medical reasons. Take a look at Larry and you will see, this poor man needs cannabis to cope which is a million times better than taking mountains of mind bending medication. Leave these honest, kind, caring, loving, amazing people alone already. The RBC has foreclosed on their home and dumped them out in the cold, even before their trial. Innocent till proven guilty or is it the other way around! Boycott RBC!

It is time everyone wakes up and smells the coffee. Alcohol and cigarettes are legal and they KILL.......cannabis does NOT. Do some research and empower yourself with information and spread the good word. End prohibition and legalize cannabis for recreational use PERIOD.

Larry and Lynda's $200,000+ house was just sold by the Royal Bank for $140,000. A close friend actually went behind their backs and purchased the home. Larry and Lynda are distraut and upset. I dont know what else to do to help them. The need a really good pro-bono lawyer that will sure the town of Terrace, RCMP and the Royal Bank. What they have done to these awesome people is incomprehensible and they deserve to be compensated BIGTIME! Please any ideas would be awesome.
