This should read "McWilliams has since died from prohibition"...he was abiding by his bail conditions to stay away from marijuana, which he used to control nausea. Unable to do so, he choked on his own vomit.

I feel so sick right now about all this, my heart just aches for Renee, Chris and Shiva.

I live around the corner from my area's Liberal MP, and have known him my whole life as I grew up with his daughter. I'm going to stop by for a chat with him today, he should be home from Ottawa for the weekend. He's a conservative liberal for sure, from a small town, against same-sex marriage...I need to plan my strategy very carefully for maximum efficacy- any suggestions?

This visit will be the first of many communications with him about this. If all goes well he'll be hearing from someone in his riding about this every single day until September 30.

What else can I do???

Justice Minister Irwin Cotler has ordered the extradition of a woman who faces trial in California for tending marijuana plants at the Cannabis Castle, a Bel Air mansion that served as one of the state's first medical marijuana grow-ops in the 1990s.

Renee Boje, 35, who has a Canadian husband and young son, surrendered herself yesterday to court officials in British Columbia. She was granted bail while pursuing judicial review of Mr. Cotler's decision. That process will postpone her extradition until at least the end of September.

The American citizen sought refugee status in Canada in 1998 following her arrest on drug trafficking charges -- charges she believes exaggerated her role in the medicinal marijuana project.

In B.C., Ms. Boje helped found a club that delivered medical marijuana to cancer and AIDS victims on the Sunshine Coast; she married Chris Bennett, manager of the POT-TV website, and gave birth to a son, Shiva, in 2002.

Ms. Boje's many defenders -- author Noam Chomsky, filmmaker Michael Moore and actor Woody Harrelson are among those who have written letters of support -- have cast her as a pawn in the misguided U.S. war against drugs.

Her lawyer, John Conroy, argued she was the victim of political persecution in the U.S. because of her views on medical marijuana. He also told Mr. Cotler that she would suffer cruel and unusual punishment if returned because of the harsh U.S. approach to marijuana offences and a prison system rife with violence.

Ms. Boje, he said, would face a minimum sentence of 10 years in prison if convicted for taking part in the medical marijuana project launched by two California cancer victims. In Canada, the same kind of offences draw a maximum sentence of two years in jail, Mr. Conroy said.

Mr. Cotler, however, rejected all of the arguments presented on behalf of Ms. Boje, including her contention that she smoked marijuana in keeping with her Gnostic faith.

"If Ms. Boje is not surrendered, Canada would be denying our extradition partner's treaty request and allowing Ms. Boje to escape trial," Mr. Cotler concluded in his 19-page decision made public yesterday.

In a telephone interview yesterday, Ms. Boje's husband, Chris Bennett, said the family was deeply disappointed by Mr. Cotler's "narrow" decision.

"It was pretty disheartening: the decision takes no account of human rights or her personal situation," he said. "This is a decision based purely on trade interests with the Americans," Mr. Bennett charged. "He (Mr. Cotler) has bought into a witch hunt to assure trade."

Mr. Cotler noted that since Ms. Boje does not have a criminal record, she will not be subject to the 10-year minimum sentence if convicted of the drug offences.

The justice minister also rejected the argument that Ms. Boje should be allowed to stay in Canada since her actions were legal in California at the time. In 1996, California had adopted the Compassionate Use Act, legislation that allowed those with their doctor's approval to grow marijuana for medicinal purposes.

Ms. Boje, a freelance artist, had been hired that same year to illustrate two books on medical marijuana being written by Peter McWilliams and Todd McCormick. The men had become advocates after using the drug to relieve the nausea that accompanied their cancer treatments.

Ms. Boje believed her involvement in their medical marijuana project was therefore legal.

But when federal drug authorities raided Mr. McCormick's Cannabis Castle in July 1997, more than 4,000 marijuana plants were removed. (Mr. Cotler noted the plants could produce about three kilograms of marijuana.)

Mr. McCormick and Mr. McWilliams argued that they needed that many plants to conduct cross-breeding experiments, but law enforcement officials insisted the operation greatly exceeded anything required for personal use.

The men eventually pleaded guilty to drug offences. Mr. McWilliams died before serving jail time.

Ms. Boje was charged with conspiracy to manufacture and distribute marijuana on the strength of evidence from a police surveillance team that said that she was observed watering and moving plants.

Mr. Cotler said Ms. Boje was wrong to believe her actions were sanctioned by the law since only those individuals with a medical recommendation for marijuana could be involved in its manufacture and use. "Even if Ms. Boje mistakenly believed that what she was doing was legal, mistake of law is not a defence under American or Canadian law," he wrote.

On her website, Ms. Boje says her case represents an important precedent for other "drug war refugees."

I think there's one there in Vancouver as well.
I'm in T.O. and if someone wants to put something together with me I'd go on with someone.

I was just sitting here watching Chris, Renee and Shiva at the court house, very upsetting. My eleven year old was in the room also watching it and asked if she could write a letter, so now she's sitting in her room sniffling and writing Irwin Cotler asking him not to make the little boys Mom leave. She's really upset!
I'll post what she writes when she's done. I've already sent mine.

But, unfortunately, Marc's suggestion, which aired on CBC Television, that Renee turn herself over to US authorities to strike a deal with them hurts Renee situation with Canadian public perception and it buys into Cotler's statements for rejecting Renee's refugee status.

Was watching it on cbc, with others, that statement, made a few here go, yea why not turn herself in. After how long Renee and Chris been fighting this, and to just give up like that, i dont understand why this was even thought of. Sometimes we must watch what our fingers type, but also what we say to the media. Keep up the hard fight, Our blessings go out to your family. No child needs to be seperated from its mother. There is no just cause for it. To strike a deal with the usa, would only make you, Chris a single parent. Love and Peace to Renee, Chris, and Shiva, Peace Out SeaOfGreen

Dear Mr. Colter

It was with great sadness and a heavy heart that I read of your decision on June 16 to order the surrender of Renée Bojé to US authorities. While my spirits have been somewhat raised by the decision of the Judge to release her on bail pending a further hearing, I am still very concerned that she will eventually be sent back to the US to face the unjust charges pending against her. I find it difficult to believe that my government is even entertaining the idea of depriving a young child of his mother, or a loving husband of his wife. That the country I love so much is willing commit such an atrocious act fills me with a deep sense of shame.

I fail to understand how you can convince yourself that Renée will be able to get a fair trial if returned to the United States. It has been shown repeatedly that the Federal Government of the United States of America has no respect for the will of its people. The people of California, where Renée was residing at the time of her arrest, exercised their democratic right and in a state-wide vote the majority of them voted in favor of Proposition 215. As far as I and many others are concerned, Renée was acting in accordance with the laws of the state of California, and the federal government has no jurisdiction in the matter.

Surely you are aware that Renée will not be allowed to enter any sort of a medical or religious use arguments in her own defense. By ordering her return to US authorities under these conditions you are condemning her to a prosecution based solely on her political and spiritual beliefs. This is an unconscionable act, an act that I and many others on both sides of the border can neither forgive or forget. Canada is looked upon worldwide as a nation based on compassion, logic, and a deep-rooted respect for democracy ... and yet you choose to ignore all of these ideals in ordering her surrender.

I wonder, as I suspect many others do ... if you would be willing to make this same decision were the geography different; if the country to which you are ordering her return was not our rowdy, disrespectful neighbor to the south. There is no doubt in my mind that you are under considerable pressure from our largest trading partner, and I wonder how much that fact has weighed into your decision (whether or not you are prepared to admit as such). We have a wonderful history of offering refuge and sanctuary to those persecuted worldwide for their political and religious beliefs, except when it comes to the United States; we – along with nations worldwide – consistently allow them to impose their will on the rest of the planet without opposition.

For too long Canada has tacitly approved the strong-armed thug tactics of the United States of America; we continuously stand by silent while they run roughshod over both the will of their citizens and the entire spirit of democratic process on a global scale. I submit to you that the time has come to stand up to them, to refuse to send this innocent wife and mother to the hellish embrace of the American prison system. There is no doubt in my mind that if returned not only will she not be given a fair trial, but she is at serious risk of mental, physical, and sexual abuse during the course of her incarceration. Amnesty International has released several reports decrying the deplorable conditions found in the prison system south of the border, and I urge you to take a close look at their information while you still have time.

You are condemning Renée to not only the abuses of a corrupt penal system, but to separation from her loving family. Her husband, Canadian activist Chris Bennett, would be unable to visit her during her incarceration as the Americans have already indicated he would be denied entry into the country. If the thought of a loving wife, mother, and all around caring and compassionate soul being cruelly ripped away from her family and subjected to such tortures does not strike you as “shocking to the conscience” then I shudder to think what would ...
